1. Acceptance

These terms (“Terms”) govern your access to and use of the website at suqoon.ca (the “Site”) operated by 13329224 Canada Inc., operating as Suqoon (“we” or “our”). By accessing or using the Site, you represent that you have reached the age of majority in your jurisdiction and have the legal capacity to accept these Terms. If you do not agree, do not use the Site.

If you engage our services, the relationship will also be governed by a separate Client Services Agreement, which prevails over these Terms to the extent of any conflict. These Terms do not alter the terms of any Client Services Agreement you may have with us.

2. Our Services

Suqoon provides in-home companion care and personal support services in the Greater Toronto Area, including companionship, help with daily living, light housekeeping, meal preparation and postpartum support. The Site provides information about our services and allows you to book and purchase services online.

2.1 Service Exclusions

The following are outside the scope of our services:

(a) Medical, nursing or regulated health services. Our caregivers are not licensed health professionals and do not perform controlled acts under the Regulated Health Professions Act, 1991 (Ontario).

(b) Medication handling. Caregivers provide verbal or visual reminders only.

(c) Transportation. Caregivers do not drive Clients.

(d) Stand-alone child care. During postpartum engagements, a parent or guardian must remain in the home and retain primary responsibility. Caregivers do not assume sole care of children under 13.

(e) Financial transactions on behalf of Clients.

(f) Use of mechanical lifts or patient-lifting equipment.

3. Purchasing Services

3.1 Bookings and Orders

You may book individual visits or purchase service packages through the Site. Placing a booking or order constitutes an offer to purchase the services described. We may accept your order by sending a confirmation, or we may decline it for any reason. If we decline, we will notify you at the email address you provided and will not charge you.

Service descriptions and pricing on the Site are subject to change without notice. We reserve the right to limit, refuse or cancel orders, including orders that appear to contain errors in pricing or description.

3.2 Payment

Payments are processed by Stripe, Inc. By submitting payment information, you authorize Stripe to charge the applicable amount to your chosen payment method. You represent that you are authorized to use the payment method provided.

The processing of payments is subject to Stripe’s own terms of service and privacy policy. We are not responsible for errors by Stripe. We do not store full credit card numbers on our systems.

3.3 Cancellation and Refunds

If you need to cancel a confirmed booking:

(a) Cancellations made more than 48 hours before the scheduled visit will receive a full refund less a 3% processing fee.

(b) Cancellations made between 24 and 48 hours before the scheduled visit will receive a 50% refund less a 3% processing fee.

(c) Cancellations made less than 24 hours before the scheduled visit are not eligible for a refund.

The 3% processing fee reflects the non-recoverable transaction costs charged by the payment processor and applies to all refunds. Refunds will be processed to the original payment method within 5–10 business days.

For service packages, unused visits may be refunded on a pro-rata basis less the 3% processing fee, subject to any minimum commitment period set out at the time of purchase.

We reserve the right to cancel a booking at any time. If we cancel, you will receive a full refund with no processing fee deducted.

4. Not Medical Advice

The Site does not provide medical advice, diagnosis or treatment. Nothing on the Site is intended as a substitute for the advice of a qualified health care provider.

5. Use of the Site

The Site is intended for use by persons located in Ontario. If you access the Site from outside Ontario, you do so at your own risk and are responsible for compliance with local laws. Use the Site only for lawful purposes. You may not attempt to access non-public areas of the Site or its infrastructure, introduce malicious software, or reproduce or redistribute Site content without our written consent.

6. Intellectual Property

Content on the Site — text, graphics, logos, images and software — is owned by or licensed to 13329224 Canada Inc. and protected by applicable intellectual property laws. “Suqoon” is a trade name of 13329224 Canada Inc. You may not reproduce, distribute, modify or create derivative works from Site content without our written consent.

7. Inquiries and Communications

The Site includes contact forms and other channels for reaching us. Information you submit is handled in accordance with our Privacy Policy. Submitting an inquiry does not create a client relationship or obligate us to provide services.

8. Feedback

If you submit suggestions, ideas or other feedback about our services or the Site, we may use that feedback for any purpose without compensation or obligation to you. Do not submit feedback that you consider confidential or proprietary.

9. Third-Party Links and Services

The Site may link to external websites and uses third-party services (including Stripe for payment processing). We are not responsible for the content, privacy practices, availability or terms of third-party sites or services. Your use of Stripe is subject to Stripe’s own terms and privacy policy.

10. Disclaimers

The Site is provided “as is” and “as available.” We do not warrant that the Site will be available without interruption, free of errors, or secure. Information on the Site is for general reference and may not reflect the specific terms of any individual engagement. Descriptions of services and pricing are subject to change.

11. Limitation of Liability

To the extent permitted by law, our aggregate liability for any claim arising from your use of the Site or any purchase made through it is limited to the amount you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, incidental or punitive damages.

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including severe weather, pandemic, utility failure, labour disruption, government action or internet outage.

Nothing in this section limits liability that cannot be limited under Ontario law, including the Consumer Protection Act, 2002.

12. Privacy

Our Privacy Policy, available on the Site, describes how we handle personal information, including payment information. It is incorporated into these Terms by reference.

13. Changes

We may update these Terms by posting a revised version on the Site. Material changes will be identified on the Site. Continued use after a change constitutes acceptance of the revised Terms. Changes to cancellation and refund terms will apply only to bookings made after the revised effective date.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of the Ontario courts.

15. General

If any provision of these Terms is unenforceable, the remaining provisions continue in effect. No failure or delay in exercising a right under these Terms constitutes a waiver of that right. These Terms, together with the Privacy Policy and any applicable Client Services Agreement, constitute the entire agreement between you and us regarding the Site and purchases made through it.

16. Accessibility

We are working toward compliance with the Accessibility for Ontarians with Disabilities Act, 2005 (AODA) and the Web Content Accessibility Guidelines (WCAG) 2.0 Level AA. If you encounter accessibility barriers on the Site, contact us and we will make reasonable efforts to provide the information in an accessible format.
